1. Acceptance and service description
By creating an account, connecting channels, or using Birmind by Fragmind, you accept these terms, our Privacy Policy, and the applicable policies of Meta, WhatsApp, and connected providers.
Birmind lets customers manage conversations, configure AI agents, connect WhatsApp Business Platform, respond to customers, manage templates, automate tasks, and analyze conversations.
2. Accounts, permissions, and responsibilities
- You must provide accurate information about your company, channels, users, and contact details.
- You are responsible for keeping your credentials, users, Meta accounts, and connected phone numbers secure.
- You must have the legal right to upload, process, and use the data, documents, conversations, and contacts entered into Birmind.
- You must review automated responses and configure human escalation when the conversation requires it.
3. WhatsApp Business and messaging rules
- You may contact people on WhatsApp only if they provided their phone number and agreed to receive communications.
- You must respect unsubscribe, block, or opt-out requests made inside or outside WhatsApp.
- Outside the 24-hour customer service window, you must use only approved templates for the authorized purpose.
- You must maintain an accurate WhatsApp Business profile with customer support information.
- You must provide a clear path to a human agent, email, phone, support website, or form when applicable.
- You must not send spam, misleading, fraudulent, offensive, illegal, or restricted-product messages without complying with applicable rules.
4. Acceptable use, AI, and suspension
You may not use Birmind to violate laws, third-party rights, Meta/WhatsApp policies, send unsolicited messages, impersonate others, access systems without authorization, or process sensitive data without a proper legal basis and safeguards.
AI-generated responses may be incomplete or incorrect. The customer must configure, supervise, and review agents before using them in real conversations. We may suspend access if we detect fraud, abuse, security risk, or non-compliance.
5. Ownership, changes, and contact
The customer keeps ownership of its data and content. Birmind and Fragmind retain ownership of the platform, software, brand, interfaces, and technology. We may update these terms when the service, legal requirements, or third-party policies change.
